Copyright & DMCA Policy

1. Ownership

All content in the app — exercise videos, photographs, texts, plans, translations, graphics, logos, the Hyperion / FitCoach brand elements and the software itself — is owned by X-APP Szoftverfejlesztő Kft. or its licensors, and is protected by US and international copyright, trademark and other laws.

2. Limited license to you

We grant you a personal, non-exclusive, non-transferable license to view and use the content within the app for your own non-commercial training purposes. You may not copy, record, download (except via features we provide), redistribute, publicly perform, sell or create derivative works from the content without prior written consent.

3. Your content

Photos and entries you upload (meal photos, measurement photos, log entries) remain yours. By uploading, you grant the Operator a limited license to store, process and display them solely to provide the service to you (including AI analysis). We do not use your uploads for marketing without consent.

4. DMCA takedown notices

If you believe content in the app infringes your copyright, send a written notice to our designated DMCA agent with: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material and its location (URL); (d) your name, address, phone and e-mail; (e) a statement of good-faith belief that the use is unauthorized; and (f) a statement, under penalty of perjury, that the information is accurate and you are the owner or authorized to act.

5. Counter-notice

If your material was removed and you believe this was a mistake, you may send a counter-notice containing your signature, identification of the removed material and its prior location, a statement under penalty of perjury that removal resulted from mistake or misidentification, and your consent to the jurisdiction of the federal court for your district (or Los Angeles County, California if outside the US).

6. Repeat infringers

Accounts of users who repeatedly infringe copyrights may be terminated in appropriate circumstances.
